South Australian Civil and Administrative Tribunal (SACAT)

The South Australian Civil and Administrative Tribunal began operation on 30 March 2015. It replaced a number of other Tribunals and Boards such as the Residential Tenancies Tribunal and the Guardianship Board.

Objectives [s 8]

Objects of the South Australian Civil and Administrative Tribunal Act 2013 (SA) include:

  • independent decision making
  • natural justice and procedural fairness
  • high-quality and consistent decision making
  • transparency and accountability
  • accessibility
  • expediency
  • Alternative Dispute Resolution (ADR)
  • low cost
  • plain language
  • less formal and technical
  • flexibility.

SACAT membership:

  • President of the Tribunal [see ss 9-11, 30]
  • Deputy President(s) [ss 13-17]
  • Magistrates [s 18]
  • Ordinary members and senior members [ss 19-21]
  • Assessors [s 22].

Who sits on the Tribunal? [ss 23-26]:

The President may determine which member or members of the Tribunal will hear certain matters or certain types of matters [s 23(1)]. The Tribunal may be constituted by one, two or three members [s 23(2)]. Where there is more than one member, the most senior member will preside [s 24]. A matter heard by more than one member will be resolved by the majority decision, but if members are equally divided, the presiding member will decide [s 25].

A question of law may be referred to a Presidential member of the Tribunal, who may decide the matter (and otherwise determine the dispute between the parties) or refer it to the Court of Appeal for determination [s 26].
