How to read an Act

Notes:

  • Commencement dates are often crucial when offences or penalties are altered because the law applicable is the law at the date of the incident.
  • Acts sometimes repeal other Acts or certain provisions of Acts. This may be done expressly or by implication.
  • If an Act contains transitional provisions then that law will apply in the changeover from the old regime to the new.
  • Acts often authorise the making of delegated legislation which permits the Executive Council (or the authorised body) to make specific provisions about the subject matter of the Act
  • The Legislation Interpretation Act 2021 (SA) defines certain terms and general rules for the interpretation of South Australian Acts and legislative instruments; for example, references to time, distance, age and amounts, the meaning of words, service of documents
