Vicarious liability

In general, employers are legally responsible for the actions of their employees, and principals for the actions of their agents, even if they did not instruct or even know about the behaviour. The law expects employers to take responsibility to ensure that unlawful discrimination, harassment or victimization does not occur in their workplace. This can include having a policy prohibiting this behaviour, conducting training to make staff aware of the policy, having a process by which staff and customers can complain and taking prompt action to deal with a complaint if it arises.
